ROBERTSON CREATIVE TERMS AND CONDITIONS
1. Reservation of the videographer’s services are guaranteed only upon receiving a non-refundable deposit of £295.00 by bank transfer. Bank details below.
2. The balance is due 1 calendar month before the wedding date.
3. It is the client’s responsibility to secure access to areas for videography. Robertson Creative will not be responsible for permits or coverage lost due to access restrictions.
4. The videographer reserves the right to use the video footage for promotional purposes.
5. In the event of a postponement or cancellation of this event, the deposit is non-refundable.
6. Robertson Creative will be the exclusive professional videographer. Friends and family are permitted to operate video cameras on the condition that they do not interfere with or get in the way of the professional coverage. This includes content creators unless agreed otherwise.
7. Robertson Creative will not be held liable for any production problems beyond our control, e.g. bad weather including extreme heat, accidents, poor acoustics/lighting, interference from guests, etc.
8. Robertson Creative is not liable for any loss resulting from disruption of a livestream due to power outages, loss of Internet Connection, venue equipment failure or audio/video issues at the event location. 9. Videographers(s) and staff shall be provided with a meal at the reception and allowed reasonable time for eating. No videotaping will be done at this time unless prior arrangements have been made with Robertson Creative.
10. In the event we are unable to attend, we reserve the right to assign or sub-contract any or all of the rights and obligations under these terms and conditions to such assignment or sub-contract.
11. Any liability on the part of Robertson Creative will be limited to the amount of monies paid.
12. Robertson Creative reserves the right to terminate this contract at any time for any reasonable cause, e.g. accident or ill health. In this event all monies paid will be refunded in full.
13. Creative aspects such as shooting and editing style are at the discretion of Robertson Creative.
14. The video will be completed within 120 days after the wedding date.
15. Upon taking possession of the finished product, the client must inform Robertson Creative of any technical or other problems with the video within 7 days. After 7 days, if no notification has been received, the client will be deemed to be satisfied with the product.
16. Robertson Creative keeps client files for 6 months after delivery to the client. It is the client’s responsibility to download and save all files to their personal devices within this time.
17. The footage may contain camera flashes if your hired photographer is using flash while Robertson Creative is filming.
18. Any additional fees incurred by Robertson Creative (such as parking fees, etc) are to be reimbursed by the client before the final product is delivered.
19. Copyright will be owned by Robertson Creative.
Force Majeure and Safe Environment Clause
1. If Videographer cannot perform or believes they may not be able to perform this Agreement in whole or in part due to a fire, natural disaster, act of war or terrorism (domestic or foreign), epidemic or pandemic (including COVID-19), action of any governmental authority, national or regional emergency, other casualty, act of God, or other cause beyond the control of the parties or due to Videographer’s illness or injury, whether or not foreseeable (“Force Majeure Event”), then Videographer will give notice to the Client as soon as reasonably practicable after Videographer determines that a Force Majeure Event will or may prevent Videographer from performing under this Agreement. Videographer shall have no obligation to perform under this Agreement and no liability for delays or failures to perform due to a Force Majeure Event, but Videographer may, in Videographer’s discretion, work with the Client to find an alternative date for the Event that is suitable to both Client and Videographer. In the case of a Force Majeure Event, Photographer shall have no additional liability to Client with respect to this Agreement beyond that described in this Section and below. 2. Client understands that Videographer works to maintain a safe work environment, including but not limited to, complying with applicable governmental laws, directives, orders, and regulations (each a “Governmental Order”).
Client further understands and agrees that Videographer shall not be required to perform under this Agreement if the Event is held in violation of a Governmental Order or Videographer’s participation in the Event would violate a Governmental Order. Client also understands and agrees that Videographer is not obligated to continue to perform under this Agreement if Videographer’s personal safety or well-being has been or will be comprised or threatened at the Event, including, but not limited to, as a result of the condition of the venue for the Event, or the conduct of an attendee of the Event.
Delivery In Detail
The client has the right to distribute the website link to the trailer as they wish. Robertson Creative will still claim the right to use this trailer for promotional and advertising purposes.
The final product shall be hosted on the Robertson Creative PRIVATE Vimeo page. The client will receive the link. Should hard copies be desired, Robertson Creative can deliver Personalised USBs at an additional cost (unless it is included in the package).
Robertson Creative cannot guarantee the delivery date but estimate that it shall be dispatched within 120 days after the date of the wedding. Robertson Creative will inform the client should there be any delay in the delivery of the product.
Robertson Creative shall inform the client upon the upload of the final product onto Vimeo. Upon taking possession of the finished product, the client must inform Robertson Creative of any technical or other problems with the film within 7 days. After 7 days, if no notification has been received, the client will be deemed to be satisfied with the product.
